Please read this carefully. Fundamenta Wellness offers educational health coaching. It is not medical care and does not replace your doctor. Keep taking your medications exactly as your prescribing provider directs, and talk with your medical team before making any change to your medications, diet, exercise, or treatment.

These Terms of Use (“Terms”) apply to your use of fundamentawellness.com (the “Website”), including applying for and booking a call with us. By using the Website, submitting an application, or booking a call, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

1. Who We Are

The Website is operated by Fundamenta Wellness LLC (“Fundamenta,” “we,” “us,” or “our”), owned and operated by Michael Rutherford, 424 W Bakerview Rd, Ste 105-2050, Bellingham, WA 98226-8176. You can reach us at [email protected].

2. Use of the Website

You must be at least 18 years old and live in the United States. The Website and our services are not available to residents of New York.
Our program is intended for adults who have already been diagnosed with type 2 diabetes by a healthcare provider.
Give us accurate and complete information, including on your application.
Do not use the Website in violation of any law, submit false or misleading information, attempt to gain unauthorized access to our systems, interfere with the Website, or use it to send spam.
We may suspend or end your access to the Website at any time if you violate these Terms.

3. Applying and Booking a Call

The Website lets you apply and book a call with us. Nothing is sold on the Website. Applying or booking a call does not obligate you to buy anything, and it does not obligate us to accept you. Enrollment is by application, we accept only a limited number of clients each month, and we may decline any application for any lawful reason. Applying or booking a call does not create a client relationship. Any program, its scope, and its price are discussed on your call and agreed to at enrollment, before you pay.

4. Not Medical Advice; Educational Coaching Only

Fundamenta Wellness provides educational coaching. It is not medical care.

We do not diagnose, treat, cure, or prevent any disease, and nothing on the Website or in our calls or messages is a diagnosis, prescription, or medical advice.
Our coaching does not create a doctor-patient or other healthcare provider-patient relationship, and it is not a substitute for care from your own doctor or medical team.
Continue taking your medications as prescribed. We do not tell you to start, stop, or change a medication or dose. Any medication change must be decided by you and your own prescribing provider, and we encourage you to consult your medical team about any changes.
Talk to your doctor before starting any new diet, supplement, exercise, or testing approach, particularly if you take insulin or other glucose-lowering medications, which can cause low blood sugar, or if you are pregnant, nursing, or have other medical conditions.
In an emergency, such as symptoms of very high or very low blood sugar, chest pain, or trouble breathing, call 911 or go to the nearest emergency room. Do not rely on our website, messages, or calls in an emergency.
These statements have not been evaluated by the FDA.

5. No Insurance

Our services are self-pay. We do not accept health insurance, do not bill insurance, and do not provide billing codes or paperwork for reimbursement.

6. Results Vary; Program Terms

Everyone’s body is different. Testimonials and examples on the Website reflect individual experiences, are not typical of every person, and are not a promise that you will get the same results. We do not promise or guarantee any particular result on this Website, including any change in your A1C, weight, blood sugar, medication needs, or health.

If you later enroll in a program, the program is governed by the terms you agree to at enrollment, not by this Website. Fundamenta reserves the right to select the devices (including continuous glucose monitors), laboratories, and tools used in a program. A1C is measured by a standard laboratory blood draw. All sales are final.

7. Text Messages and Email

If you agree on our application, we will send you text messages and emails about your call and related topics, as described in our Privacy Policy. Consent is not a condition of purchase. 8. Intellectual Property

All content on the Website, including text, graphics, logos, videos, and materials, belongs to Fundamenta Wellness LLC or its licensors and is protected by copyright and other laws. You may view the Website for your own personal use. You may not copy, share, resell, record, or create derivative works from our content, or use our names and branding, without written permission.

9. Third-Party Services

The Website and our services use or link to third parties, such as scheduling and messaging platforms (for example, GoHighLevel), payment processors (such as Stripe), and LabCorp and other third-party laboratories. We are not responsible for their content, services, or practices, and their own terms and policies may also apply.

10. Disclaimer of Warranties

To the fullest extent permitted by law, the Website is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Website will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, Fundamenta Wellness, Michael Rutherford, and our team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising from your use of the Website. Our total liability for any claim relating to the Website will not exceed the amount you paid us, if any, in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, and some states do not allow certain limits, so they may not apply to you.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Whatcom County, Washington, and you agree to those courts’ jurisdiction. 13. Changes to These Terms

We may modify these Terms at any time by posting the updated version with a new effective date. Your continued use of the Website after changes means you accept them. If any part of these Terms is found unenforceable, the rest stays in effect.
