Summary. We collect the information you give us when you apply and book a strategy call, including health details you choose to share. We use it to decide whether the program is a fit and to coach you. We do not sell your personal information. We do not share mobile phone numbers or SMS consent with third parties for their marketing. You can text STOP at any time to end text messages.
Fundamenta Wellness LLC (“Fundamenta,” “we,” “us,” or “our”) is owned and operated by Michael Rutherford. This Privacy Policy explains how we collect, use, and protect your information when you visit fundamentawellness.com, apply for our 1:1 type 2 diabetes coaching program, book a strategy call, receive our emails or text messages, or become a client.
We do not use your health information to advertise to you based on your health condition, and we do not intentionally send health details, such as your diagnosis, A1C, medications, or your application answers, to advertising platforms.
We do not sell your personal information, and we do not share it for third-party marketing. We share it only as follows:
Mobile information. No mobile information, including your phone number and your text messaging consent, will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors, such as the platform and carriers that deliver our messages, is solely to support message delivery and is not for their own marketing.
When you provide your mobile number and check the consent box on our application, you agree to receive text messages from Fundamenta Wellness, such as call confirmations, appointment reminders, scheduling follow-ups, and program-related and educational messages.
We send text messages between 9:00 a.m. and 7:00 p.m. in your local time zone, except for appointment reminders sent shortly before a scheduled call, which may arrive outside those hours.
We send emails about your application and call, and, if you are on our list, educational and promotional emails. Every marketing email includes an unsubscribe link. You can also email us at [email protected] to opt out. We may still send you service messages that are necessary for a program you have joined.
Cookies are small files stored on your device. Pixels are small pieces of code that tell us or an advertising platform that a page was viewed or an action was taken. We use:
You can control cookies in your browser settings and block or delete them. You can opt out of personalized ads through your Meta Ad Preferences, the Digital Advertising Alliance, and the Network Advertising Initiative. Blocking some cookies may affect how the site works.
The health information you share with us is sensitive, and we treat it with care. We use it only to evaluate your application, provide our coaching, and operate our business, as described in this policy.
Fundamenta Wellness is not a “covered entity” under HIPAA, because we do not bill insurance or transmit health claims electronically, so HIPAA does not govern the information you give us.
Some states have laws that protect consumer health data, such as Washington’s My Health My Data Act and Nevada and Connecticut laws. Where those laws apply, we obtain consent before collecting or sharing consumer health data as required, and you may have additional rights to access and delete that data and to withdraw consent. See Section 9.
We keep your information for as long as needed to provide our services, meet legal, tax and accounting obligations, resolve disputes and enforce our agreements. Marketing contact records are kept until you unsubscribe or ask us to delete them. You may ask us to delete your information sooner (see Section 9), and we will do so unless we are required or permitted by law to keep it.
We use reasonable technical and organizational measures to protect your information, including working with providers that use encryption and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affects your information, we will notify you as required by law.
Depending on where you live, you may have the right to:
California residents. Under the California Consumer Privacy Act (CCPA/CPRA), you have the rights listed above. In the past 12 months we have collected the categories of information described in Section 1 (identifiers, contact information, internet activity, and sensitive personal information such as health information) for the purposes in Section 2, and disclosed them to the categories of service providers in Section 3. We do not knowingly sell or share the personal information of consumers under 16.
Residents of Washington and other states with consumer privacy or consumer health data laws may have similar or additional rights, including the right to appeal a denied request.
How to make a request. Email [email protected] with “Privacy Request” in the subject line. We may need to verify your identity, and we will respond within the time required by law (generally 45 days). You may use an authorized agent to make a request on your behalf. If we deny a request, you may appeal by replying to our decision, and you may contact your state attorney general.
Our website and services are for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us information, contact us and we will delete it.
Our website may link to other websites, such as a lab, a CGM maker, or social media. We are not responsible for their privacy practices, and we encourage you to read their policies.
Our services are offered in the United States only, and are not available to residents of New York. Your information is stored and processed in the United States.
We may update this policy from time to time. We will post the updated version here with a new effective date. If we make a material change to how we use health information, we will tell you and get your consent where required.
